Approximately 45 days after your case is filed, you will also meet with a trustee at the Meeting of Creditors. Angela attends this meeting with you. A confirmation hearing is also required for a Chapter 13 bankruptcy. This hearing is in front of a judge and occurs about 90 days after your case is filed. Again, Angela prepares and attends this hearing with you. You are not alone during this process. A Chapter 13 bankruptcy is a better choice for people who are facing foreclosure and/or repossession of their car and who want to keep those items because a Chapter 13 can stop that collection activity and give you a chance to make those past due payments. A Chapter 13 bankruptcy is often called a wage-earner bankruptcy. This type of bankruptcy establishes a plan for a person to pay some of their debt while discharging other debt. A Chapter 13 bankruptcy requires that you have regular income in order to make that payment. This disposable income will be paid to the trustee each month. The trustee will then distribute that payment to your creditors.
