Credit Counseling & Financial Management Courses

 

In 2005, the Bankruptcy Abuse Prevention and Consumer Protection Act (BAPCPA) was passed.  BAPCPA created new procedures and requirements for bankruptcy filers.  One of these new requirements is that a credit counseling course is to be completed before someone files bankruptcy.  The credit counseling  is a short program that can be taken over the phone, internet or in person from a US Trustee-approved provider.  After the program is completed, the filer is given a certificate that must be filed with the petition, schedules and statements.

After the bankruptcy is filed, the client is required to take another financial management course.  This short program provides the filer with tools and information regarding budgeting and managing credit after bankruptcy.  The US Trustee’s Office provides a list of approved providers.  The financial management certificate is filed with the Bankruptcy Court.
